GenPresso Terms of Service

1. Purpose

These Terms govern your use of GenPresso (the "Service"), an AI studio for generating and editing images, video, and audio, provided by 주식회사 리콘랩스 (RECON Labs Inc.) ("Company", "we").

2. Service Provider and Payment Processing

The service provider and your contracting party is 주식회사 리콘랩스, a company incorporated in the Republic of Korea. Payments are processed by our wholly-owned U.S. subsidiary, RECON Labs Inc., through a payment processor (e.g. Stripe); the payment descriptor on your statement may show the subsidiary's name. Regardless of who processes payment, responsibility for the Service and for refunds/consumer protection rests with the Company as service provider.

3. Accounts

An agreement is formed when you accept these Terms and the Privacy Policy, register, and we accept your registration. The Service is for users aged 14 and older. You are responsible for your account credentials and activity.

4. Credits and Subscriptions

• You may buy credits or subscribe to use paid features. Paid actions (e.g. AI generation) deduct credits per our pricing.
• Subscriptions auto-renew each billing cycle (monthly/annual). You may schedule cancellation at any time before the next charge; cancellation takes effect at the end of the current cycle.
• Complimentary credits (e.g. sign-up bonuses) are non-refundable and non-transferable.

5. Refunds

• Unused credit top-ups may be refunded within 7 days of purchase.
• Credits already consumed correspond to digital content that has been supplied and are non-refundable; only the unused balance is refundable.

6. Your Content and Rights

• You retain rights to and responsibility for content you input or upload, and you warrant it does not infringe third-party rights or violate law.
• You grant us the rights needed to store, process, and transmit your content (including to third-party AI processors) to provide and improve the Service.
• You may use generated outputs to the extent permitted by law and by our and our AI providers' policies. Legal ownership of AI outputs may be subject to applicable law; you are responsible for your use of outputs.

7. Research and Statistical Use

We may use data arising from your use of the Service — prompts, uploaded and generated media, and usage records — for statistical purposes and for scientific research aimed at improving the Service and advancing generative AI.

• Before any such use, the data is pseudonymised so that no individual can be identified without additional information, or aggregated into statistics that identify no individual. For users in Korea this follows Art. 28-2 of the Personal Information Protection Act; for users in the EEA and UK we rely on our legitimate interests (Art. 6(1)(f) GDPR) with the safeguards required by Art. 89(1) GDPR.
• We do not use pseudonymised data to attempt to identify any individual. If information identifying an individual is produced during processing, we stop processing immediately and retrieve and destroy that information.
• Research use under this section does not include training or fine-tuning AI models on your inputs or outputs.
• Research results are published or used only in a form from which no individual can be identified; your prompts and generated media are never published verbatim.
• You may ask us to exclude your data from research use under this section at any time by writing to support@genpresso.ai. Your use of the Service is unaffected.

Because pseudonymised data cannot be linked back to you without additional information, an exclusion request takes effect for processing from the time of the request onward and cannot be applied retroactively to data already pseudonymised. The categories of data and the retention periods are set out in the Privacy Policy at /legal/privacy. Where we wish to use personal data in identifiable form for research, we will ask for your separate consent.

8. Promotional Use of Your Content

We may use the content listed below to promote the Service, and for that limited purpose you grant us a free, non-exclusive licence. Private content that falls outside this list is not used for promotion.

• Projects and their generated outputs that you have made public yourself, by setting a project's visibility to public or by creating a public share link.
• Content you submit to an event, contest, interview, or case study where you separately agree to promotional use.

Promotional use means posting, displaying, reproducing, and transmitting the content on the Service's website and app, on social media accounts we operate, in online and offline advertising and promotional materials, and in press releases. Editing is limited to resizing, shortening, and excerpting to fit the format of the medium.

• We do not display your handle, display name, or other information identifying you alongside the content, unless you have separately agreed to a credit — in which case we display it only as agreed.
• If you set the project back to private, or ask us to stop at support@genpresso.ai, we will stop publishing the content on the channels we control without delay.
• Promotional use is unpaid, and we will never require it or make it a condition of using the Service.
• This section does not affect the rights you hold in your content under Section 6 and transfers no ownership to us.

A takedown reaches only the channels we control; it cannot reach copies already printed and distributed, or reshared on third-party platforms beyond our recall. If a project you made public contains a third party's likeness or copyrighted work, clearing those rights remains your responsibility under Section 6. We check that content meets the requirements of this section before using it.

9. Prohibited Uses

You must not use the Service to:

• Create deepfakes or misuse a real person's likeness, voice, or personal data to deceive or impersonate.
• Infringe others' copyright, trademark, or other intellectual property.
• Create or distribute child sexual abuse material, non-consensual intimate imagery, or other unlawful, obscene, hateful, or violent content prohibited by law.
• Spread disinformation or defraud others.
• Disrupt the Service, abuse it via automated means, or reverse-engineer or circumvent our systems or models.

We may remove or block reported/violating content and restrict accounts without prior notice. Report unlawful content to support@genpresso.ai.

10. Changes, Suspension, and Termination

We may modify or suspend the Service for maintenance, provider issues, or other reasonable cause, with notice where practicable. You may terminate anytime by deleting your account in Settings; we may restrict or terminate accounts that violate these Terms or law.

11. Disclaimers and Liability

• AI outputs are generated automatically and may be inaccurate, inappropriate, or infringe third-party rights. You are responsible for checking legality and accuracy before use; we do not warrant outputs.
• We are not liable for losses caused by events beyond our reasonable control, including failures of third-party AI providers, payment processors, or infrastructure.
• Nothing here limits liability that cannot be limited under applicable law.

12. Governing Law

These Terms are governed by the laws of the Republic of Korea, and disputes are subject to the courts having jurisdiction under applicable law. Effective August 18, 2026.
